Terms of Service

1. Description of Service

Artempo is a social and gamification-driven application that lets you discover museums, galleries, exhibitions and cultural venues in your city on a map, create routes, check in at venues, collect stamps in your digital passport and share content with other users.

2. Account Creation and Age

You must be at least 13 years old to use the Service. Users under 18 are encouraged to register with parental consent.

You must provide accurate and current information when registering. You are responsible for the security of your account (password, OTP, device access). Contact us immediately if you suspect unauthorized access.

3. User Generated Content (UGC)

The Service supports user content such as feed posts, photos, routes, comments and profile information. By uploading content you agree to the following:

• You retain ownership of your content. You grant Artempo a worldwide, royalty-free, transferable, sublicensable license to host, display, distribute and promote your content in connection with the Service.
• You represent that you own all rights to the content you upload, or have obtained the necessary permissions.
• You may delete your content at any time, although complete removal from backup systems may take time.

4. Prohibited Content and Conduct

The following content or conduct is prohibited and results in account suspension/removal:

• Content that infringes copyright, trademark or other intellectual property rights
• Violence, hate speech, discrimination, harassment, sexual exploitation
• Spam, deceptive links, phishing attempts
• Knowingly false or misleading information, fake accounts, impersonation
• Promotion or advertising of illegal products/services
• Automating, scraping or manipulating the Service infrastructure
• Content that violates the privacy of other users (non-consensual photos, personal information)

5. Location, Notifications and Permissions

The Service requests location permission to enable map, route and check-in features. Background location permission may also be requested for stop-approach/arrival notifications during an active route. All permissions are granted at the operating system level and can be revoked from device settings at any time.

Denying location permission limits map and route features; this does not constitute a loss of right.

Push notifications are sent only with your permission. Detailed permission management is available in-app under Profile > Notifications.

6. Gamification and Virtual Items

The Service may award virtual items such as digital stamps, passport pages, counters and points for your visits. These items have no real-world monetary value, cannot be withdrawn or transferred. Accumulated virtual items are lost when an account is closed or suspended.

7. Account Deletion

You may delete your account at any time from within the app via Profile > Settings > Delete Account. Upon receiving a deletion request, your personal data is irreversibly deleted within 30 days.

Content tied to interactions with other users (comments, likes) may be anonymized or removed.

8. Service Changes and Termination

Artempo reserves the right to modify, suspend or discontinue the Service or any feature, free or paid. We will make reasonable efforts to notify you of material changes in advance.

If you violate these Terms or applicable law, we may suspend or delete your account without prior notice.

9. Third-Party Services

The Service works with third-party providers in areas such as map tiles, push delivery, authentication and email (see Privacy Policy, Section 5). Those providers' own terms and availability guarantees apply. Artempo is not directly liable for interruptions in third-party services.

10. Intellectual Property

The Artempo brand, logo, design system, codebase, content curation and database structure belong to Artempo. Open-source components are used under their own licenses.

You may use the Service under a limited, non-transferable, revocable license for personal use. Reverse engineering, decompilation and distribution of copies are prohibited.

11. Limitation of Liability

The Service is provided "as is". To the maximum extent permitted by law, Artempo shall not be liable for indirect, incidental, special or consequential damages, lost profits or lost data.

Our total liability is limited to the amount you paid for the Service in the last 12 months (0 TL for free use).

These limitations do not apply to willful misconduct or where prohibited by law.

12. Indemnification

You agree to indemnify Artempo against all claims arising from your breach of these Terms, your content infringing third-party rights or unlawful use of the Service.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. Disputes are subject to the exclusive jurisdiction of the Istanbul Çağlayan Courts and Enforcement Offices.

Users who qualify as consumers retain the right to apply to the consumer courts of their place of residence.

14. Changes to the Terms

We may update these Terms from time to time. We will notify you via in-app notice or email for material changes. Continued use of the Service after a new version is published constitutes acceptance of the updated terms.
